ADVERTISING BUSINESS GUIDELINES
  • All private ads equal 1 item per ad space regardless of ad size. With a limit of advertising 5 private items per issue.
  • 1 total price only to be listed in the ad, if GST applies, GST inclusive price to be displayed.
  • No business names to be printed in the ad- no links to businesses or other items for sale in web addresses.
  • Private ads are second-hand / used equipment. Equipment can be sold "with work"; however, details of a business for sale can not be included.
  • All cars, bikes & number plates must have a $ figure listed in the advertisement as well as a registration, engine or VIN number for cars & bikes.
  • Items advertised must pertain to the magazine’s title
  • Private rate advertising layouts are limited to the publisher’s standard layouts
  • Advertising will run in the Issue booked by the customer
  • An advertisement is not confirmed until it is paid for
  • Payment is via CC only
  • Ad creation is a 5 step process (About you, enter ad details, Choose ad package, Make payment and Summary)
  • Only one ad space per booking is accepted (No multiple ads in the one booking); however multiple bookings can be made (Limit of 5 per issue)
  • Once an advertisement is confirmed it can be cancelled by calling Prime Creative Media Pty Ltd (without refund) but cannot be amended by the advertiser

TERMS AND CONDITIONS
Acceptance of all advertising is subject to review and approval by management, the publisher reserves the right to edit, revise or reject any advertisements for any reason. The Publishers’ liability for damages resulting from errors in any advertising that it publishes or from its failure to publish any advertisement that is has agreed to publish shall be limited to it actually received in consideration for its agreement to publish the advertisements in question. The Publisher shall not be responsible for any special, incidental or consequential damages suffered by any party resulting from its errors and/ or omissions. The advertiser accepts all liability for the content of all advertising supplied by it and agrees to defend, indemnify and hold harmless the Publisher from any and all claims. All photographs become the property of Prime Creative Media Pty Ltd (ACN 053 273 546). For dealer and commercial advertising these terms and conditions should be read in conjunction with the terms, conditions, warranties and indemnities published on our dealer and commercial rate cards.

'UNTIL SOLD' PACKAGES (LIMITED TIME ONLY)
In addition to the above terms and conditions Private advertisers booking an 'until sold' advertisement are solely responsible for re-booking their ad each issue until it is sold. The Publisher (Prime Creative Media Pty Ltd) shall not be responsible for the failure to re-publish an ad booked 'until sold'.

It is the advertisers responsibility to remove a sold item from sale by notifying the Publisher immediately the item is no longer for sale.

'Until sold' packages are subject to a 'limited time only' caveat and the Publisher (Prime Creative Media Pty Ltd) reserves the right to withdraw or cancel the 'until sold' package at anytime.

Further, the publisher reserves the right to change the size and appearance of an 'until sold' ad at its own discretion without further notification.

INDEMNITY
The publisher (Prime Creative Media Pty Ltd) will not be liable for any loss or damages (including direct, indirect, consequential, incidental and exemplary):
  • in relation to a notice or advertisement not appearing according to instructions;
  • if the Site (DIYads.com.au) is unavailable to users (by virtue of interruption, suspension or termination) for any reason, including due to computer or communications link downtime attributable to malfunction, upgrades or preventative or remedial maintenance activities;
  • if there is any deficiency or inaccuracy in a published advertisement
By placing a private advertisement an advertiser agrees to indemnify and hold harmless The Publisher (Prime Creative Media Pty Ltd), its employees and agents from and against all actions, proceedings, suits, claims and demands brought or made against Prime Creative Media Pty Ltd by any person arising from or as a consequence of such an action and from and against any damage, loss, cost or expense suffered or incurred by Prime Creative Media Pty Ltd as a direct or indirect consequence of that action.

Users shall indemnify the Publisher (Prime Creative Media Pty Ltd) in relation to defamation, liable, slander of title, infringement of copyright, infringement of trademarks or names of publication titles, unfair competition, breach of Trade Practices or Fair Trading legislation, breach of motor dealer legislation, violations of rights of privacy, confidential information, licenses, loyalty rights or other intellectual property rights.

These terms and conditions shall be governed by the laws of the state of Victoria. The parties agree to submit to the exclusive jurisdiction of the courts exercising jurisdiction there.

PHOTOGRAPHS
Good photographs really do help sell your item. Where possible use good, digital photos and stand at least 20 feet / 6 metres away from the subject you are photographing.

MULTIPLE INSERTIONS
Please check your advertisement on its first appearance. No credits will be given for incorrect advertisements after the first month of publication.

VENDORS RESPONSIBILITIES
Vendors should be aware of the legal requirements of each state when advertising products for sale.

GOVERNMENT REGULATIONS WARNING!
Government Regulations covering the advertising for used vehicles have changed From July 1, 1998 advertisements for the sale of registered motor vehicles published in National newspapers and magazines are now required to include:-

  • The cash price of the vehicle
  • The registration number
  • If unregistered, then the engine number
The regulations are applicable for both private individuals and Motor Traders and are to promote fair trading practices in the private market. As the penalties are substantial for both the advertiser and publication, we can no longer accept advertisements that do not comply.
